Terms of use
Terms of use.
Last updated: 2026-10-17.
Purpose
These terms govern the use of OpenCookies: cookie consent banner, cookie-free audience measurement, technical tests, customer area, WordPress plugin, API and MCP server. By creating an account or installing the banner, you accept them.
The service is published by Antoine Bartrolich (see the legal notice).
What the service does, and what it does not do
OpenCookies is a technical tool. It blocks known tracking services until the visitor has given consent, keeps proof of the choices and regularly checks the result in a browser.
OpenCookies does not provide legal advice and does not guarantee that your site complies with the law. Reports describe what an automated browser observed on a given date; they do not replace the advice of a legal professional. The generated cookie policy is provided for information: you remain responsible for its content.
Your account
You declare that you have the capacity to enter into this contract and to act for the sites you declare. You provide an accurate e-mail address, keep your password confidential and are responsible for what is done with your account.
You only declare sites that you own or are authorized to manage. The free plan allows 1 site; the Pro and Agency plans are described below.
Your responsibilities as data controller
For the visitors to your sites, you are the data controller and OpenCookies is your processor (see data processing). It is up to you to choose the categories and texts of the banner, to inform your visitors, to keep your privacy policy up to date and to check that the banner works on your pages.
A tracking tag written directly in a page’s code may be downloaded by the browser before the banner. The customer area shows you how to fix it; whether to fix it is your decision.
Acceptable use
- Do not disrupt the service, circumvent its limits, or use it to test sites abusively or repeatedly.
- Do not try to access the data of other accounts, or to divert the banner to collect data without visitors’ knowledge.
- Do not install the banner on a site whose content is illegal.
We may restrict or suspend an account that does not follow these rules, after notifying the person concerned except in urgent cases.
Availability
The service is provided “as is”, with the reasonable care of a service provider, without a guarantee of continuous availability. The banner script is loaded from our servers: if they are unreachable, the banner does not appear and tracking services are no longer blocked by it. Maintenance operations may briefly interrupt the service.
Plans and prices
OpenCookies offers three plans. Prices are stated including all taxes (VAT). The up-to-date detail is on the Pricing page: la page Tarifs (opencookies.com/tarifs.php).
- Free: €0, 1 site. Full banner, automatic blocking, Consent Mode v2, cookieless audience measurement, one on-demand test per month and one automatic test per month. Default appearance (no choice of colors, size, corners or font), “Powered by OpenCookies” mention, consent log kept 3 months without export, no change alerts or reports under your brand.
- Pro: €6 per site per month. Everything in Free, plus free appearance, removal of the “Powered by OpenCookies” mention, consent log kept for 13 months with CSV export, change alerts, on-demand tests with no monthly limit and reports under your brand.
- Agency: €31 per month for 25 sites, then €1 per month for each extra site. All Pro features on every site of the account, the overview of your clients, the transfer of a site to its final owner and a single invoice.
Prices are fixed: they depend neither on the number of visitors, nor on the number of page views, nor on the number of pages analysed, and no tier changes automatically. A price change is announced by e-mail at least 60 days before it applies and only applies to the following period.
Payment: the Pro and Agency plans are paid online by bank card (provider: Stripe Payments Europe, Ltd. (Dublin, Irlande)). Subscriptions renew automatically each month (or each year for a yearly subscription) until cancelled.
Consumers’ right of withdrawal: le service s’adresse d’abord aux professionnels.
Cancellation and refunds
You cancel a paid plan in one click from “My account”, with no fee or supporting document. Cancellation takes effect at the end of the period already paid: you keep the paid features until then, then the site returns to the Free plan (default appearance, “Powered by OpenCookies” mention, log limited to 3 months).
Satisfaction guaranteed or your money back: you can ask for a full refund of your first payment within 30 days of it, by simple e-mail to contact@opencookies.com. After that period, the current period is not refunded, except where the law requires.
If the service is interrupted through our fault for more than 72 consecutive hours, we refund the days concerned pro rata on request.
Term and end of the contract
The contract is concluded for an indefinite period. You can delete your account at any time from the “My account” page: your sites, banners and associated data are then deleted and the banner stops working on your sites. Remember to remove the installation code from your pages.
We may end the service or an account in the event of a serious breach, or with reasonable notice. You can export your consent proofs (CSV) before deletion.
Liability
To the extent permitted by law, OpenCookies’ liability is limited to direct and foreseeable damage. For a business customer, it is capped at les sommes versées par le client au cours des 12 derniers mois, and OpenCookies is not liable for indirect losses (loss of revenue, customers or data, fines or penalties). Nothing in these terms excludes the rights that the law guarantees to consumers.
Changes to the terms
We may change these terms. The date of the last update appears at the top of the page; in the event of a significant change, account holders are notified before it takes effect.
Governing law and disputes
These terms are governed by le droit français. In the event of a dispute, contact us first at contact@opencookies.com. Consumers may use a consumer mediator free of charge: [MÉDIATEUR DE LA CONSOMMATION], and keep the benefit of the mandatory provisions of the country where they live.
Failing an amicable settlement, the competent courts are those of Rennes, subject to the mandatory jurisdiction rules applicable to consumers.
